By accessing or using the services provided by Ideal CDPAP (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”) and any other applicable guidelines or rules. If you do not agree to these Terms, you must not use our services.

Description of Services

Ideal CDPAP provides services as a New York State Consumer Directed Personal Assistance Program (CDPAP) facilitator, including but not limited to consumer registration, Personal Assistant registration, care coordination, intake, enrollment, compliance support, and other related services. We also offer digital and SMS communication to keep you informed about our services and updates.

User Obligations

As a user of our services, you agree to:

• Use our services for lawful purposes only.

• Provide accurate and complete information when required.

• Respect the rights and privacy of others in all interactions.

You must not engage in any activity that disrupts or interferes with our services or their security, including unauthorized access or use of our systems.

SMS Consent and Mobile Information Policy

By providing your mobile phone number and opting in to receive SMS communications from Ideal CDPAP, you consent to receiving text messages related to our products, services, promotions, or other business-related information.

We respect your privacy, and your mobile phone number and any SMS consent you provide will not be shared with third parties for marketing or promotional purposes. We will only use your mobile information in accordance with our Privacy Policy, strictly for the purpose of communicating with you as outlined at the time of your consent.

You may opt out of receiving SMS communications at any time by following the instructions provided in the messages, opt-in form, or by contacting us directly.

Limitations of Liability

Ideal CDPAP will not be liable for any damages, including but not limited to indirect, incidental, special, consequential, or punitive damages, arising from your use of our services or your inability to use our services.

Termination of Services

We reserve the right to suspend or terminate your access to our services at any time, without notice, if we believe you have violated these Terms or any applicable law.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws principles. Any disputes arising from these Terms or your use of our services will be subject to the exclusive jurisdiction of the courts located in New York.
