Acceptance of Terms

By accessing or using the services provided by Ideal CDPAP LLC (doing business as Ideal CDPAP) (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”) and any other applicable guidelines or rules. If you do not agree to these Terms, you must not use our services.

Description of Services

Ideal CDPAP LLC is a New York State-approved facilitator for the Consumer Directed Personal Assistance Program (CDPAP), partnered with Public Partnerships LLC (PPL), the statewide Fiscal Intermediary. Our services include consumer registration, Personal Assistant registration, care coordination, intake, enrollment, compliance support, and other related services. We also offer digital and SMS communication to keep existing patients, designated representatives, and Personal Assistants informed about their participation in our program.

User Obligations

As a user of our services, you agree to:

• Use our services for lawful purposes only.

• Provide accurate and complete information when required.

• Respect the rights and privacy of others in all interactions.

You must not engage in any activity that disrupts or interferes with our services or their security, including unauthorized access or use of our systems.

SMS Consent and Mobile Information Policy

By providing your mobile number and opting in to receive SMS from Ideal CDPAP, you consent to receive customer care messages.

• Message frequency may vary. On average, 1-2 messages per month.

• Message and data rates may apply.

• You can opt out at any time by replying STOP.

Examples of the Messages You May Receive

Recipients of our SMS program are existing patients (and their designated representatives and Personal Assistants) enrolled in the New York State Consumer Directed Personal Assistance Program (CDPAP). Examples of the account notification and customer care messages we send include:

• Appointment reminders (for example, UAS-NY nurse assessments, intake or registration calls);

• Account and eligibility notifications (for example, reminders that your Medicaid coverage, MCO authorization, government-issued ID, or care plan is approaching expiration and must be renewed to remain active in the program);

• Compliance reminders (for example, Personal Assistant training deadlines in the Nevvon portal, weekly PPL timesheet approval reminders before the Sunday 12:00 PM ET deadline, and EVV compliance);

• Customer care messages (for example, follow-ups about missing registration documents, scheduling support, document-submission status, and answers to inbound questions);

• Account status updates (for example, registration completion confirmations, Personal Assistant returned or non-compliant status, and MCO “Undetermined” status notices).

We do not send marketing or promotional text messages. Consent to receive SMS is not a condition of receiving services.

Sharing of Mobile Information

Your mobile telephone number, SMS consent, and mobile information will not be sold, shared, transferred, or disclosed to any third party or affiliate for marketing or promotional purposes. Mobile information may be shared only with subcontractors that operate our SMS messaging platform on our behalf, and only to deliver the messages described in this Section 4. Those subcontractors are contractually prohibited from using your information for their own marketing or promotional purposes.

How to Opt Out and How to Get Help

• To opt out of SMS messages at any time, reply STOP to any SMS message you receive from us.

• To obtain help, reply HELP to any SMS message you receive from us.

Limitations of Liability

Ideal CDPAP LLC will not be liable for any damages, including but not limited to indirect, incidental, special, consequential, or punitive damages, arising from your use of our services or your inability to use our services.

Termination of Services

We reserve the right to suspend or terminate your access to our services at any time, without notice, if we believe you have violated these Terms or any applicable law.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws principles. Any disputes arising from these Terms or your use of our services will be subject to the exclusive jurisdiction of the courts located in New York.

Changes to Terms of Service

We reserve the right to update or modify these Terms at any time without prior notice. Any changes will be effective immediately upon posting to our website. Your continued use of our services following any changes constitutes your acceptance of the revised Terms.
